The first segment starts with a definition of two dimensions of the concept of rule of law; related to the notion of sovereignty and as a concept to control arbitrariness on the part of the ruler. The segment proceeds to give a historical account of the notion and the different stages of its epistemological configuration, from the ancient Greek notion of Eunomia and its incompatibility with the popular rule to the current notion, where the rule of law has become fused (...) with democracy and human rights. The first segment also focuses on the relation between the concept of the rule of law and other principles, such as proportionality, neutrality, and effectiveness. The second segment of the paper analyses the phenomenon of juridification of the rule of law in international treaties and domestic constitutions. It pays particular attention to the role that constitutional accommodation plays in the process of rationalization of the rule of law as a prerequisite to its idealization and mystification. It analyses the reason why this principle is an essential feature of the constitutionalism despite the inner plurality of legal systems. The next aspect, analysed in the third segment of this paper, is the messianic use of the concept of the rule of law. The paper performs a critical definition of messianic, covering a theological perspective and the different theories and concepts that go hand in hand with the idea of the Messiah, such as the “coming”, prophetical and apocalyptical messianism, the phenomena of eschatology, expiation and redemption pictured in Judaism. The segment also covers the secular transplantation of the messianic thought. The last segment is a conclusion returning to the themes identified in the paper and summarises how the messianic thought is applied in the realm of the rule of law. (shrink)

The present article commences analyzing the origins and influences of the religious discourse on the configuration of the modern constitutional discourse and the contributions of the jus-positivism in the consolidation of this sacred-civil language. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. ABSTRACTOrganization and management researchers praise the value of care in the workplace. However, they overlook the conflict between caring for work and for coworkers, which resonates with the dilemma of care allocation highlighted by ethicists of care. Through an in-depth qualitative study of two organizations, we examine how this dilemma is confronted in everyday organizational life. We draw on the concept of boundary work to explain how employees negotiate the boundary of their caring responsibilities in ways that grants or denies (...) care to coworkers. We argue that the possibility of an ethics of care for coworkers requires boundary work that suspends the separation of personal and professional selves and constitutes the worker as a whole person. We contribute to research on care in organizations by showing how care for coworkers may be enabled or undermined by maintaining or suppressing the care allocation dilemma. (shrink)

This paper deals with Hobbes's theory of optical images, developed in his optical magnum opus, ‘A Minute or First Draught of the Optiques’, and published in abridged version in De homine. The paper suggests that Hobbes's theory of vision and images serves him to ground his philosophy of man on his philosophy of body. Furthermore, since this part of Hobbes's work on optics is the most thoroughly geometrical, it reveals a good deal about the role of mathematics in Hobbes's philosophy. (...) The paper points to some difficulties in the thesis of Shapin and Schaffer, who presented geometry as a ‘paradigm’ for Hobbes's natural philosophy. It will be argued here that Hobbes's application of geometry to optics was dictated by his metaphysical and epistemological principles, not by a blind belief in the power of geometry. Geometry supported causal explanation, and assisted reason in making sense of appearances by helping the philosopher understand the relationships between the world outside us and the images it produces in us. Finally the paper broadly suggests how Hobbes's theory of images may have triggered, by negative example, the flourishing of geometrical optics in Restoration England. (shrink)

In a classical paper [15] V. Glivenko showed that a proposition is classically demonstrable if and only if its double negation is intuitionistically demonstrable. This result has an algebraic formulation: the double negation is a homomorphism from each Heyting algebra onto the Boolean algebra of its regular elements. Versions of both the logical and algebraic formulations of Glivenko’s theorem, adapted to other systems of logics and to algebras not necessarily related to logic can be found in the literature (see [2, (...) 9, 8, 14] and [13, 7, 14]). The aim of this paper is to offer a general frame for studying both logical and algebraic generalizations of Glivenko’s theorem. We give abstract formulations for quasivarieties of algebras and for equivalential and algebraizable deductive systems and both formulations are compared when the quasivariety and the deductive system are related. We also analyse Glivenko’s theorem for compatible expansions of both cases. (shrink)

In Bangladesh due to improved quality of life the number of people over 60 years is increasing rapidly. This should be seen as an emerging challenge as the elderly will have special needs and require different care-giving services. Since Bangladesh does not have a social welfare system there will be competition for inadequate resources specially health and medical services. It is envisaged that due to more elderly population the demographic structure will undergo a slow change from the present pyramid structure. (...) The growing trend towards nuclear family or where children live abroad will put the elderly parents in a dilemma-the financial and social support that is essential for them has not yet emerged. The nutrition and health status of elderly people depend on adequate food safe water, proper sanitation facilities and maintaining hygienic standards. To provide special medical care for the elderly there is a need to establish WHO recommended Age-Friendly Primary Health Care centers and separate wards /units are to be set up in the hospitals. To reduce vulnerability of older women there is a need to distribute assets and properties according to the law.. Our new generations have to be responsive, informed and attentive about their duties and responsibilities towards the elderly people. Taking proper care of the elderly is our ethical duty and responsibility. (shrink)

This paper is an attempt to develop a paradigm in problem solving where the notion of virtuality plays a central role. Following a brief discussion on virtual simulation, the paper attempts to identify a notion of virtuality based on the identification of the self (man or computer) with the problem solver. It is shown that such an identification/distinction possibly violates some general principle of the problem environment.To deal with this violation, a new problem is generated and a new virtualization act (...) is required, in order to attain a correspondence between virtuality and reality. A better understanding of this approach requires a combination of analog and digital reasoning: the analog being related to the environment in which the problem solving is required, and the digital to the problem solver's “mental” activities.We will briefly analyze the recursive approach to problem solving and suggest a possible problem solving methodology based on virtuality. The paper concludes with comments on the relation between etnology and virtual reality. (shrink)

El objeto de este estudio es el análisis del papel y la función del fr. 241 Bernabé en la exégesis del demiurgo que aparece en el libro II del Comentario al Timeo de Proclo. Este análisis se centra en el primero de los tres demiurgo-Zeus que caracterizan el panteón de este autor, el contenido en la tríada intelectiva Cronos-Rea-Zeus, y plantea la cuestión de por qué opta por el uso de la teología órfica en lugar de la caldaica. Para responder (...) a esta pregunta, el estudio se divide en tres partes: a) el análisis de la estructura y el contenido del fr. 241 Bernabé; b) el vínculo que establece el Comentario al Timeo entre Orfeo, Pitágoras y Platón; y c) la definición que este tratado ofrece el demiurgo y su adaptación a la teología órfica. La conclusión a la que se pretende llegar es que, en este caso concreto, el uso del orfismo viene dado por la adecuación de la segunda creación al concepto de demiurgo defendido por Proclo. (shrink)

En este trabajo se analizan los argumentos de Berkeley a favor del inmaterialismo. Especial atención se dedica al argumento a priori que subyace en el lema esse est percipi, y sobre todo a la manera en que Berkeley entiende el concepto de existencia y el valor metafísico que otorga a su significación. Asimismo, se explica también cómo este inmaterialismo es un espiritualismo o realismo teológico puesto al servicio de causas apologéticas.

En este artículo se pretende analizar hasta qué punto las filosofías de Ortega y Wittgenstein compartirían un horizonte filosófico común. En este sentido se presentan, aunque con matices distintos, los siguientes elementos comunes: el rechazo del realismo metafísico y el cientismo, el abandono de la concepción sustancialista del sujeto, la irrupción en la discusión filosófica del significado o el sentido como algo que necesita comprensión o aclaración, la urgencia de solucionar el problema de la autenticidad.

Katz (1981, 1985) has denied the psychological import of Linguistics on the grounds of alleged inconsistencies that arise when Linguistics is conceived as a psychological enterprise, and proposed an alternative Platonistic conception. The paper discards the plausibility of this latter approach to the study of natural language but recognizes the difficulties Katz has pointed out. It is claimed that these difficulties appear if the “strong competence hypothesis” (Bresnan & Kaplan, 1982) is assumed, that is, if it is assumed that the (...) form of the speaker’s knowledge of language is that of a grammar. A weaker conception of the psychological relevance of linguisitic theories is proposed-one that avoids Katz’s difficulties, is more congenial to Chomsky, and clears the way for a fruitful cooperation between Linguistics and Psycholinguistics. : Accidents will survive the outbreak of driverless cars, but their moral implications will suffer substantial changes. The decision made today by a human in a fraction of a second will eventually be replaced by an algorithm subject to moral scrutiny. This not only raises the question of how the algorithm should work, or whether alternatives solutions are indeed comparable, but also changes the essence of the problem: from ascertaining liability to defining desired outcomes. In this paper, I first contest (...) two possible approaches to resolving the driverless car dilemma – which I call statistical and nominal – to conclude that neither is morally sound. I then propose an alternative solution based on “time-relative equality”, or always sparing younger people. This follows from seeking an egalitarian solution, that is the least intrusive – a position I defend from a possible ageist critique. Le decisioni prese oggi in una frazione di secondo dagli esseri umani saranno alla fine sostituite da un algoritmo soggetto a controllo morale. Sorge non solo il problema di come dovrebbe funzionare questo algoritmo – o se vi siano soluzioni alternative comparabili –, ma cambia anche la sostanza del problema: dall’accertamento dell’imputabilità alla definizione dell’esito auspicato. In questo lavoro discuterò due possibili approcci per risolvere il dilemma – che chiamerò “statistico” e “nominale” –, per concluderne che non sono moralmente corretti. Proporrò quindi una soluzione alternativa, basata sulla “eguaglianza tempo-relativa”, il principio per cui bisogna sempre salvare il più giovane. Questo segue dal cercare una soluzione egalitarista, che sia la meno intrusiva – una posizione che difenderò da una possibile critica che la vede come discriminatoria verso gli anziani. Celem niniejszego artykułu jest krytyczna prezentacja głównych tez pewnej wersji współczesnego deizmu, zaproponowanej przez Roberta Corfe’a, autora książki Deism and Social Ethics: The Role of Religion in the Third Millennium. Nie jest to prosta kontynuacja osiemnastowiecznego angielskiego deizmu Jana Tolanda i Mateusza Tindala. Deizm Corfe’a jest refleksją filozoficzną, biorącą pod uwagę osiągnięcia współczesnych nauk przyrodniczych. Autor podejmuje taką refleksję w przekonaniu, że główne zagrożenie światowego pokoju wypływa z konfliktów między przedstawicielami religii monoteistycznych: chrześcijaństwa i islamu. Jego zdaniem głównym zadaniem współczesnego (...) deizmu jest budowanie porozumienia ponad religiami poprzez odwołanie się do racjonalnej perswazji, możliwej do przyjęcia przynajmniej przez niektórych przedstawicieli tych religii. Proponowana wersja deizmu miałaby być globalną etyką, odniesioną do nieosobowego kosmicznego Bóstwa (Dobra), zrywającą ze wszystkimi nadnaturalnymi religiami, które Corfe oskarża o kultywowanie irracjonalizmu, szkodliwego samego w sobie. Mimo że deizm Corfe’a nie przeradza się w ateizm, wbrew zapewnieniom autora Deism and Social Ethics nie stanowi skutecznej zapory przeciw temu ostatniemu. Autor niniejszego artykułu pokazuje, że koncepcja Corfe’a nie jest wewnętrznie spójna, jest niedopracowana teoretycznie i w znacznie mniejszym stopniu racjonalna, niż się Robertowi Corfe’owi wydaje. W istocie nie stanowi ona przekonującej alternatywy dla religii monoteistycznych takich jak chrześcijaństwo. (shrink)

Philosophical postmodernism, since its beginning, has aroused controversies and was met with a great deal of criticism. One has to state, however, that there is an enormous confusion concerning what in essence this criticized philosophical approach is, i.e.: what is postmodernism? The aim of this paper is an attempt to clarify postmodernism by showing a significant part of its current reception, its relation with other philosophical currents, and pointing out some “myths” connected to it. As the title says, the presented (...) article is a “voice years later”, so it is a voice asking about postmodernism today — when it is more mature and grounded than in the 1970s or 1980s. From this perspective, the main question of the text is: what kind of postmodernism (or: what understanding of postmodernism) makes sense and has value for contemporary philosophy. (shrink)

Building on the discussion between Stephen Darwall and Michael Tomassello, we propose an alternative evolutionary account of moral motivation in its two-pronged dimension. We argue that an evolutionary account of moral motivation must account for the two forms of moral motivation that we distinguish: motivation to be partial, which is triggered by the affective relationships we develop with others; and motivation to be impartial, which is triggered by those norms to which we give impartial validity. To that aim, we present (...) the second-person standpoint of morality, first as Darwall conceives of it, and then as we reinterpret it from a naturalistic approach. Then we synthesize Tomasello’s evolutionary account of morality, and Darwall’s objections to it. To reply to those objections, building on Tomasello’s proposal, we argue that the motivation to be impartial, and the feeling of obligation to comply with normative requirements, appeared when humans anticipated and, critically, internalized others’ sanctions to the violation of social norms. Consequently, we posit that social norms and sanctions appeared first at the community level, and only after that were they internalized in the form of self-directed reactive attitudes. Finally, we derive some corollaries that follow from our proposal. (shrink)

This book is a unique exploration of the idea of the "second person" in human interaction, the idea that face-to-face interactions involve a distinctive form of reciprocal mental state attributions that mediates their dynamical unfolding. Challenging the view of mental attribution as a sort of "theory of mind", Pérez and Gomila argue that the second person perspective of mental understanding is the conceptually, ontogenetically, and phylogenetically basic way of understanding mentality. Second person interaction provides the opportunity for the acquisition of (...) concepts of mental states of increasing complexity. The book reviews the growing interest in a variety of second person phenomena, both in development and in adulthood, presenting research that shows how participants in human interaction attribute psychological states of a referentially transparent kind to each other. Also looking at the implications and applications of the second person perspective within fields as diverse as art and morality, this book is fascinating reading for students and academics in social and cognitive psychology, cognitive science, neuroscience, and philosophy. In this paper, we take Darwall’s analytical project of the second-person standpoint as the starting point for a naturalistic project about our moral psychology. In his project, Darwall contends that our moral notions constitutively imply the perspective of second-personal interaction, i.e. the interaction of two mutually recognized agents who make and acknowledge claims on one another. This allows him to explain the distinctive purported authority of morality. Yet a naturalized interpretation of it has potential as an account of our moral (...) psychology. We propose a naturalistic interpretation of Darwall’s work to address some of the main issues about our moral psychology. First, we explain why moral norms motivate us; namely, because of these second-personal relations. We provide a naturalized version of this solution. Second, we articulate how intersubjective interactions take place effectively; grounding duties to particular other subjects, and being related to distinctive moral emotions. Third, we address the question of the limits of the moral community, proposing that it comprises all agents capable of second-personal interactions. Finally, we explain the emergence of community norms through intersubjective interaction. Since all group members can adopt alternatively the second-personal stance to each other, demands are sanctioned and recognized in a triangulation process which explains the emergence of group norms. The classical Glivenko theorem asserts that a propositional formula admits a classical proof if and only if its double negation admits an intuitionistic proof. By a natural expansion of the BCK-logic with negation we understand an algebraizable logic whose language is an expansion of the language of BCK-logic with negation by a family of connectives implicitly defined by equations and compatible with BCK-congruences. Many of the logics in the current literature are natural expansions of BCK-logic with negation. The validity of (...) the analogous of Glivenko theorem in these logics is equivalent to the validity of a simple one-variable formula in the language of BCK-logic with negation. (shrink)

In the last chapter of In the beginning was the deed: realism and moralism in political argument, Williams raised the question of truthfulness in politics and warned that the media, particularly, television, and the market of communication in general, work in ways contrary to truthfulness -understood as the combination of the virtues of sincerity and accuracy. In this paper we would like to carry on Williams’ line of thinking in connection with the impact of the new social media platforms on (...) politics. Where Williams focused on television, we will consider the impact of the internet public sphere. After reviewing how the digital social media encourages motivated reasoning in general, we propose to focus on two main phenomena derived from it: the rise of conspiracy theories and the moralization of politics. Conspiracy theories epitomize the risk of self-deception Williams was concerned to signal. On the other hand, the process of moralization of politics triggers sectarianism and hate for the “others”, the outgroup. Both phenomena are not exclusive of the internet sphere, but both are boosted by it, and entail a lack of interest in truth and truthfulness, and in this way they threaten the value of truth for democracy. The aim of this paper is to give a description of the free algebras in some varieties of Glivenko MTL-algebras having the Boolean retraction property. This description is given (generalizing the results of [9]) in terms of weak Boolean products over Cantor spaces. We prove that in some cases the stalks can be obtained in a constructive way from free kernel DL-algebras, which are the maximal radical of directly indecomposable Glivenko MTL-algebras satisfying the equation in the title. We include examples (...) to show how we can apply the results to describe free algebras in some well known varieties of involutive MTL-algebras and of pseudocomplemented MTL-algebras. (shrink)
